WellCall Partners — Affiliate Program Terms
Effective: June 21, 2026
These terms form the agreement between CheckWellCall ("CheckWellCall," "we," "us") and you ("Affiliate") when you participate in the WellCall Partners affiliate program. By accepting these terms in the affiliate portal, you agree to be bound by them. They supplement our Terms of Service and Privacy Policy.
1) Enrollment & Approval
- You must apply and be approved before earning commissions. We may approve or decline any application at our sole discretion.
- You must be 18+ and able to enter a binding contract in your jurisdiction.
- You must provide a valid W-9 (US) or W-8BEN (international) before any payout is released.
2) Tracking & Attribution
- You receive a unique tracking link. We attribute conversions on a last-click basis within a 60-day cookie window.
- A commission-qualifying conversion occurs when a user who clicked your link starts a free trial and activates a paid plan (first successful payment).
- We are not responsible for lost attribution caused by a user's browser settings, cookie blocking, ad blockers, or use of a different device than the one that clicked your link.
3) Commission Structure

- Commission is a percentage of the net subscription revenue we actually collect from a referred subscriber, for the duration of your tier's window.
- Annual plans: commission is the applicable percentage of the annual payment, paid once on the first successful annual invoice. The annual term satisfies the commission window.
- Tier upgrades are reviewed monthly and apply to new conversions from the upgrade date forward; they are not applied retroactively to existing recurring commissions.
- Commissions are calculated on subscription revenue only — not on taxes, refunds, or promotional discounts.
4) Payouts
- Payouts run on a net-30 schedule: confirmed earnings for a month are paid the following month.
- Minimum payout is $50. Balances below the minimum roll forward to the next cycle.
- Payment is via Stripe Connect (preferred) or PayPal. Payouts are held until a valid tax form is on file.
- We issue a 1099-NEC to US affiliates who earn $600 or more in a calendar year.
5) Clawbacks & Refunds
Commissions are subject to a 30-day clawback window. If a referred subscriber cancels, refunds, or initiates a chargeback within 30 days of a payment, the related commission is reversed from your pending balance. Commissions already paid are offset against your future earnings.
6) FTC Disclosure (Required)
You must include a clear and conspicuous disclosure of your affiliate relationship in any content promoting CheckWellCall, placed before the first affiliate link — not in a footnote or "about" page.
- Approved language: "I may earn a commission if you sign up for CheckWellCall through my link, at no extra cost to you."
- Video content must include both a verbal and on-screen disclosure.
- Social posts must add #ad or #sponsored alongside the disclosure.
You agree to comply with the FTC's Guides Concerning the Use of Endorsements and Testimonials (16 CFR Part 255).
7) Prohibited Practices
The following result in immediate termination and forfeiture of unpaid commissions:
- Bidding on CheckWellCall brand keywords (e.g., "CheckWellCall," "WellCall Circle," "WellCall Partners") in paid search.
- Spam: unsolicited mass email, robocalls, or automated social posting.
- Cookie stuffing, forced clicks, or any artificial inflation of clicks or conversions.
- False or misleading claims about features, medical benefits, or pricing. CheckWellCall is a non-medical wellness service.
- Collecting, storing, or processing any subscriber personal or health information.
- Self-referral or creating accounts to generate your own commissions.
- Using coupon, deal, or cashback sites without prior written approval from the Growth Manager.
- Promoting CheckWellCall in any context that conflicts with HIPAA privacy principles, or representing yourself as an agent of CheckWellCall for medical triage, diagnosis, or care.
8) HIPAA Boundary
CheckWellCall is built on HIPAA-compliant architecture. As an affiliate you operate outside the covered-entity boundary. You must not collect, store, or process subscriber protected health information (PHI), and you must not use any subscriber's wellness-call data in your promotions without that subscriber's written consent. Violations may expose you to separate legal liability.
9) Intellectual Property
We grant you a limited, revocable, non-exclusive license to use CheckWellCall's name, logo, and approved creative assets solely to promote the service per our brand guidelines. You may not modify the logo, imply endorsement beyond the affiliate relationship, or register domains, social handles, or trademarks containing our marks.
10) Deactivation & Termination
- Either party may end this agreement at any time. On voluntary withdrawal, confirmed pending commissions are paid on the next normal cycle.
- Accounts with zero clicks for 90+ consecutive days may be moved to inactive status.
- Termination for a compliance or fraud violation may result in forfeiture of unpaid commissions and reversal of fraudulently earned amounts.
11) Independent Contractor
You are an independent contractor. Nothing here creates an employment, agency, partnership, or joint-venture relationship. You are responsible for your own taxes and for reporting all earnings in your jurisdiction. We do not provide tax advice.
12) Changes & Governing Law
We may update these terms or the program with notice through the affiliate portal. Continued participation after a change constitutes acceptance. These terms are governed by the laws of the State of New Jersey and are subject to the dispute-resolution and arbitration provisions of our Terms of Service.
